Sponsorships allow Canadian citizens and
permanent residents to bring family members to Canada. The family
members will themselves become permanent residents, and can eventually
qualify for Canadian citizenship themselves. Sponsorships are processed at visa offices, not inside of Canada. (There is an exception for spouses and common-law partners in Canada where the immigrant has a temporary status in Canada at the time the application is made - see Spouse in Canada Class applications.)

The sponsor must be a Canadian citizen or permanent resident.

Brothers and sisters cannot normally be sponsored directly. However, if parents are sponsored, the parents can include dependant children in their application. In this way, brothers and sister often come to Canada as part of the sponsorship of the parents. Canadian citizens and permanent residents generally can NOT sponsor:
The Application
The primary issue in all sponsorship cases is the genuineness of the relationship. For example, marriages entered into in order to obtain permanent resident status in Canada, without the commitment to each other which is implicit in marriage, will not be accepted. Therefore, credibility becomes the primary issue, and corroboration becomes extremely important.
The visa office will need to be reassured that the marriage, or the adoption, has not been entered into for merely immigration purposes, but is intended to create and genuine spousal relationship or parent child relationship.
The visa office will also need to be reassured that family relationships are not falsified, and that dependant children are in fact dependant. For example, the visa office will need to be reassured that children are the age claimed, or that the children have genuinely been attending university or college. In addition to establishing the genuine nature of the relationship, the successful applicant must not be inadmissible to Canada for criminal, security, medical, or other reasons.
The successful applicant must carefully prepare the necessary forms, and support the claims made in those forms with a carefully prepared supporting package of documents and submissions. The successful applicant will also have to present well at an interview with an immigration officer.
Most rejected applications fail due to inadequate supporting packages and poor presentations at interviews. This is where qualified counsel can make the greatest difference. Properly prepared submission packages and proper preparation for interviews are at the heart of a successful application.
Processing times depend on the visa office servicing the country where the applicant has status (country of citizenship or country where the person resides with legal status). However, sponsorship of spouses and children is given the highest processing priority and so is faster than other kinds of applications. |
