Loss of Permanent Residence Status

- Breach of Condition -


Permanent residence status can be lost where the immigrant fails to respect specific conditions that have been imposed upon him or her.

For example, a person who applies for permanent residence is accepted on the strength of a promise to purchase or set up a business, and develop that business so that it meets specific performance targets including, for example, the number of people the business employs. This target is set as a Condition of the immigrant keeping his or her permanent residence status.

If the business fails to meet that target then the immigrant  risks losing his or her permanent residence status. The immigrant and his or her family can be required to leave Canada.

Depending on the circumstances, it is sometimes possible to keep permanent residence status, even if the business fails. This is determined on a case by case basis and must be very carefully handled.
